Scope and Acceptance
These Terms of Service are a binding agreement between you and Privca LLC, a California limited liability company ("Privca"). By creating an account or using the service, you accept them.
These Terms apply when you browse the website, create an account, use the dashboard, complete a Privacy Passport, select brokers or companies, authorize Privca to prepare or submit requests, track request activity, use paid plan features, or otherwise interact with Privca.
Additional policies also apply, including the Privacy Policy, Billing Terms, Refund Policy, Cookie Policy, and any in-product notices shown during checkout, setup, or request submission.
Eligibility
Privca does not operate on children's information. Account creation asks you to declare your age eligibility: no one 13 or younger may create an account or use the service, under any circumstances. The declaration is checked once and not stored; Privca does not collect birth dates. If you choose to add your age when you start an Exposure scan, it is used only for that scan and deleted when the scan finishes. If you are 14 to 17, you may create an account only through a family plan invitation from your parent or legal guardian, who must be an adult account holder, consents to your use of the service, and is responsible for your account under these Terms. At 18 or older you may create an account without restriction, and you must be able to form a binding contract. The service is operated from the United States and is designed around United States privacy rights and request routes.
Accounts belong to one person — you may not create an account for someone else to use, and you may not let someone else operate yours. Misstating your age is a violation of these Terms. If Privca learns an account belongs to someone 13 or younger, or to a 14-to-17-year-old outside a family invitation, the account is closed as described in the Privacy Policy.
Account Responsibility
You are responsible for keeping your login credentials secure and for activity performed through your account. You must provide accurate account and contact information, keep your email address current, and notify Privca if you suspect unauthorized account access. Account security tools — two-factor authentication, session review, and sign-in history — are available from your dashboard.
Privca may restrict, suspend, or terminate access when needed to protect users, receiving companies, providers, payment systems, Privca's infrastructure, or the integrity of privacy request workflows.
Privacy Passport and User Data Accuracy
Privca uses the information you provide to prepare, route, submit, monitor, and document privacy requests. You are responsible for the accuracy of the names, email addresses, phone numbers, addresses, authorization details, account context, and other locator details you provide.
Incorrect or incomplete information can cause a broker or company to reject, delay, ignore, or misprocess a request. Privca may ask you to update setup details before a request can be prepared or submitted.
Request Submissions
When you select a supported target and submit a request, you authorize Privca to prepare a request package using the relevant account, authorization, identity, locator, request goal, and evidence information available in your account.
Supported request goals may include opt-out, deletion, or both where available. Some routes may be automated, some may require operator review, and some may require you to take action directly through a company portal, confirmation email, identity challenge, or other verification process.
Privca may decline, delay, cancel, or hold a request when the route is unsupported, the request appears unauthorized, required information is missing, the request duplicates an existing active record, a receiving organization asks for user action, or processing would create security, privacy, legal, abuse, or operational risk.
No Guarantee of Third-Party Outcomes
Privca helps prepare, send, monitor, and document privacy requests. Privca does not control how a broker, company, service provider, regulator, portal, email system, or other third party responds.
A target may deny a request, ask for verification, require direct user action, rely on an exception, fail to respond, provide partial completion, or process a request on a timeline Privca does not control. Privca does not guarantee deletion, opt-out, suppression, legal eligibility, removal from every source, or a particular business outcome.
Plan Limits and Paid Features
Plans may include different request limits, broker coverage, family access, request goals, evidence features, support levels, or other functionality. Free accounts may have monthly selection limits. Paid plans may unlock broader broker coverage, opt-out and deletion workflows where supported, detailed evidence tracking, or family access.
Plan details may be displayed on the pricing page, checkout flow, dashboard, or billing portal. Privca may update plan names, features, limits, prices, or coverage as the service changes, subject to any required notice or consent for recurring charges.
Billing Terms
Paid subscriptions, renewals, cancellations, plan changes, billing errors, used-service value, refunds, and chargebacks are governed by the Billing Terms and Refund Policy. If you purchase a paid subscription, you authorize recurring charges according to the checkout terms shown to you.
Family Plan Terms
Family plan access may allow a primary payer or owner to invite additional users under the same paid plan. Family access grants plan coverage; it does not automatically make every member's private request history, Privacy Passport details, or personal request evidence visible to the plan owner.
Family features may evolve over time, including profile management, member invitations, included seats, add-on seats, billing responsibility, and member removal. Members must use their own accounts and must not submit requests for another person without permission.
The Free Exposure Scan
Privca's website may offer a free exposure scan that anyone can run without an account. It searches public people-search sites for a name in a city and state, as described in the Privacy Policy. You may search only for yourself: by ticking the box that says "I'm searching for myself and agree to the Terms of Service." you confirm that the name, city and state you type are your own and you agree to these Terms. You may not use the scan to look up anyone else, to build or check a list of people, or through automated tools, and you may not get around its human check or its limits.
The scan is limited: a network may start a small number of scans a day, all scans share a daily capacity, and Privca may pause, limit or stop the scan at any time. Its results show only what the listed sites show the public at that moment, a match can belong to someone else with the same name, and a site that could not be checked or did not find you does not mean you are not listed there. The scan's results are deleted one hour after it finishes unless you create a Privca account in the same browser within that hour, and running a scan sends no request to any company: removal happens only from an account, under the authorization and plan terms that apply to requests.
Acceptable Use and Abuse Prevention
You may not use Privca to submit false, malicious, excessive, unauthorized, unlawful, or abusive requests. You may not interfere with the service, bypass security controls, scrape private areas, reverse engineer non-public systems, probe production systems without permission, upload harmful content, attempt payment fraud, or misuse support, billing, or request workflows.
Privca may apply rate limits, request gates, manual review, account restrictions, suspension, termination, evidence preservation, or other measures to prevent misuse and protect users, companies, providers, and the platform. Good-faith security research is welcome through the Responsible Disclosure process.
Service Status and Changes
Privca is in active development. Features, provider rails, broker coverage, company routes, legal-route analysis, evidence displays, family features, dashboards, internal review tools, and supported workflows may change as the hosted service matures.
Privca may add, remove, limit, suspend, modify, or discontinue features or supported targets. The service may be unavailable during maintenance, provider interruptions, security events, third-party outages, or operational changes.
Account Closure and Data Retention
You may contact Privca for account support or closure. Some records may be retained when needed for request history, security, auditability, fraud prevention, billing, dispute resolution, legal compliance, backup integrity, or protection of the service.
Account closure may prevent future dashboard access, but it does not necessarily withdraw requests already submitted to third parties or erase records that Privca must retain for legitimate operational or legal reasons. The Privacy Policy explains retention in more detail.
No Legal Advice
Privca provides operational privacy support and request-management tooling. Privca is not a law firm, does not represent you as legal counsel, and does not provide legal advice. Information about consumer rights, enforcement strength, or privacy frameworks is general informational content and may not apply to every person, state, company, broker, or request.
Third-Party Services and Links
Privca may rely on third-party services for hosting, storage, email delivery, payments, security, monitoring, support, or request delivery. Third-party websites, portals, payment providers, and broker or company systems are governed by their own terms and policies.
Intellectual Property and Feedback
Privca's website, product workflows, text, designs, software, documentation, logos, and service materials are owned by Privca or its licensors. You may not copy, resell, or misuse Privca materials except as allowed by law or written permission.
If you provide feedback or suggestions, Privca may use them without obligation to you.
Disclaimers and Liability Limits
Privca provides the service on an "as is" and "as available" basis to the fullest extent permitted by law. Privca disclaims warranties that the service will be uninterrupted, error-free, always available, or that every third-party request will produce the result you want.
To the fullest extent permitted by law, Privca will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for losses caused by third-party responses, third-party outages, inaccurate user-provided information, unsupported requests, or unauthorized account use.
To the fullest extent permitted by law, Privca's total liability for all claims relating to the service is limited to the greater of the amounts you paid Privca in the twelve months before the claim arose or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain warranty disclaimers or liability limits, so parts of this section may not apply to you; nothing in these Terms limits rights that cannot be waived under applicable law.
Indemnification
You agree to indemnify and hold Privca, its officers, employees, and agents harmless from claims, damages, and reasonable costs (including attorneys' fees) arising from requests you were not authorized to make, identity or authorization information you falsified, your violation of these Terms or of applicable law, or your misuse of the service — except to the extent the claim was caused by Privca's own breach of these Terms.
Disputes, Chargebacks, and Support
If you believe there is a billing error, unauthorized charge, duplicate charge, account issue, or service problem, contact Privca first so the issue can be reviewed. Chargebacks, payment disputes, fraud claims, or abuse of billing workflows may result in account review, suspension, evidence preservation, or termination.
For any other dispute, both sides agree to try informal resolution first: send a written description of the dispute and the outcome you want to support@privca.com, and give Privca 60 days to work with you before starting arbitration or a court proceeding.
Arbitration and Class Waiver
If informal resolution fails, you and Privca agree to resolve disputes arising out of these Terms or the service through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of a court trial. Arbitration takes place in the county where you live or remotely by written submission or videoconference, and the Federal Arbitration Act governs this section. The arbitrator can award the same individual relief a court could.
This section does not take away rights the law protects. Either side may instead bring an individual claim in small claims court. Either side may seek public injunctive relief in court where the law makes that right non-waivable. Nothing here stops you from reporting an issue to a government agency or regulator, and good-faith security research remains covered by the Responsible Disclosure process.
Both sides waive the right to bring or participate in a class action, class arbitration, or other representative proceeding; claims are resolved one account at a time. If this class waiver is found unenforceable for a particular claim, that claim proceeds in court rather than in arbitration, and the rest of this section still applies to everything else.
You can opt out of this arbitration section entirely: email support@privca.com with the subject "Arbitration opt-out" from your account email within 30 days of first creating your account. Opting out does not affect any other part of these Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that is not subject to arbitration is brought in the state or federal courts located in California, and both sides consent to that venue.
If you live in a state whose consumer protection law gives you rights that cannot be taken away by a choice-of-law clause, you keep those rights.
General Terms
These Terms, together with the policies they reference, are the entire agreement between you and Privca about the service. If any part of these Terms is found unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver of it.
You may not assign these Terms or your account. Privca may assign these Terms as part of a merger, acquisition, or sale of assets, with notice where the law requires it. Privca is not responsible for delay or failure caused by events beyond its reasonable control, such as provider outages, natural disasters, or government action.
You agree that Privca may send notices about the service, your account, and these Terms electronically — to your account email or through the dashboard. Sections that by their nature should survive account closure — including retention, disclaimers, liability limits, indemnification, arbitration, and governing law — do survive it.
Changes to These Terms
Privca may update these Terms as the service, pricing, supported workflows, legal environment, or operational practices change. Updates will be posted with a new effective date. Continued use of the service after changes become effective means you accept the updated Terms.
